Terms of use
This is a translation; the Polish version is binding.
1. Provider and contact
PigeonTree is provided by Krystian Chęciński, trading as a non-registered business under Polish law (działalność nierejestrowana), Polish tax ID (NIP): 8281426366, Targowa 17C/10, 99-200 Poddębice, Poland, email pigeontreeapp@gmail.com. Questions, requests and complaints go to that address.
PigeonTree keeps records of pigeons, pedigrees, pairs and clutches, tasks, a journal, and flights with arrivals. It stores photos and documents, reads lists from photos, makes PDFs and saves backups of your data. Where auctions are available in the app, you can also publish selected public pigeon information, bid, watch listings and buy an optional move up or highlighting. Section 9 sets out the auction terms.
2. Guest account and getting your loft back
You do not need to create an account. The app saves data on your phone and, when there is a connection, creates a technical guest account and syncs your loft. Linking a Google account, Apple account or passkey lets you get your loft back on a new phone; photos and documents are backed up to the cloud only after the account is linked.
Protect access to your phone and account, and save a backup before changing phones. Without a linked account or your own backup, your data may be impossible to recover if you lose the phone. Signing in to another, existing account ("I already have an account") works only in an empty loft; the app never merges two lofts.
3. Requirements and offline use
You need an Android or iOS phone or tablet with the system version shown in the store, and space for your data. Saving and browsing records and making PDFs work without internet. Reading text from photos and PDFs, the map and place search, sync, cloud backup, sign-in, purchases, auctions and their current prices, and account deletion need a connection. An offline auction preview does not confirm the current price or availability of bidding.
Sync can be delayed by poor signal or system limits; the app shows what is saved on the phone and what already has a cloud backup. Before wiping a phone, check that your data has been sent, or save your own backup.
4. Your records and photos
You keep the rights to your records, photos and documents. You share them with us only as far as the app needs them: to save, sync, back up and export. Your private loft is not public. Exceptions are the information and material you deliberately approve for an auction and anything you choose to share or export.
Only add material you have the right to use, and nothing unlawful. Do not try to reach other people's data, get around security or disrupt the service.
Reading a photo can mistake ring numbers or miss pigeons, so you compare the list with the photo before a PDF is made or pigeons join a flight. Flight velocity is your own helper calculation, with no night-stop deduction, and does not replace the organiser's official results.
5. PigeonTree Plus
Free of charge: loft records with no limit on pigeons, pairs and clutches, races and training tosses, tasks and the journal, feeding programmes and task and feeding reminders, CSV export and local backup and restore, browsing pedigrees of 3–6 generations and exporting a standard 3-generation pedigree as PDF or JPG, adding pigeon and eye photographs, background removal on supported devices, and a pigeon's statistics summary. Generation counts include the pigeon itself. A linked account enables sync between devices, auction features under section 9 without a Plus requirement, and a backup of up to 100 MB of photos and documents. The app shows no ads from external advertising networks. Highlighted user auctions are labelled. A paid move up adds no label; section 9.3 explains how it affects the order.
PigeonTree Plus adds: importing loft and race records from compatible sources; reading PDFs, photographed lists and ancestors from attached pedigrees; List from photo and Add from photo; automatic eye detection; pedigree PDF and JPG exports of 4–6 generations, additional layouts and the loft's own logo; pair comparisons, predicted offspring inbreeding and offspring performance analysis; full pigeon statistics (form chart, velocities and seasons); and a backup of up to 2 GB of photos and documents. Auction moves up and highlighting remain separate purchases under section 9.3.
Prices in Poland:
- monthly subscription: PLN 12.99 per month;
- yearly subscription: PLN 79.99 per year, with 14 days free for people who have not had a subscription in the app before;
- one-time purchase: PLN 199.99, Plus without renewals.
In other countries the store shows the price in your local currency. Before you buy, the store's window shows the price including taxes, the billing period and the renewal terms; nothing is charged until you confirm in that window.
A subscription renews automatically for the next period until you cancel it. Cancel it in Google Play or the App Store at least a day before it renews; Plus then stays active until the end of the paid period. If you do not cancel the yearly subscription during the 14 free days, the store charges for the year. Deleting the app or your PigeonTree account does not cancel a subscription. "Restore purchases" checks the purchases saved on your store account.
The one-time purchase gives Plus without renewals for as long as PigeonTree is provided. We will announce the end of the service in advance, in the app and on this page.
When Plus ends, your saved data stays available and you can export it. Files already in the cloud stay there; new ones wait on the phone while the backup takes up more than 100 MB.
6. Right of withdrawal
If you are a consumer (or a sole trader buying for purposes outside your profession), you can withdraw from a contract made through the store within 14 days of making it, without giving a reason.
- A subscription is a service. If you start using it before the 14 days are over and then withdraw, you pay for the time until you withdrew.
- The one-time purchase can be delivered at once only with your express consent and your acknowledgement that you lose the right of withdrawal; without that consent and acknowledgement, the right of withdrawal remains.
To withdraw, ask the store for a refund (Google Play: your Google Play order history; App Store: reportaproblem.apple.com) or send us a statement at pigeontreeapp@gmail.com, for example using the model form in annex 2 to the Polish Consumer Rights Act. The refund follows within 14 days, through the store or, where the store does not allow it, in another way agreed with you, at no extra cost.
7. Complaints
Write to pigeontreeapp@gmail.com: describe the problem and give the app version, device model and error code if one appeared. Do not send passwords or your whole loft unless needed.
We answer a complaint within 14 days of receiving it. If the app or Plus does not work as agreed, you have the remedies of the Polish Consumer Rights Act; these terms do not exclude or limit them. Consumers can get help from local consumer ombudsmen, the Trade Inspection (Inspekcja Handlowa) and prawakonsumenta.uokik.gov.pl.
8. Stopping and changes
You can stop using the app at any time. To remove your data from the cloud, choose Delete account and data; uninstalling the app does not remove it. How we handle data is described in the privacy policy.
We may change these terms for good reasons, such as new laws, features or providers. We will publish the new text here with a new date and tell you about significant changes in the app. Changes do not take away rights you already have, and the terms of a paid period apply until it ends.
The contract is governed by Polish law; this does not deprive a consumer of the protection given by the mandatory laws of the country where they live.
9. Pigeon auctions
9.1. Roles of the platform and participants
PigeonTree provides publishing and bidding tools. The pigeon seller is the user named in the auction, not the PigeonTree provider. The seller is responsible for the right to sell, accurate information, the pigeon’s condition and documents, and their own obligations. The buyer is responsible for the bid they knowingly place and their obligations to the seller.
The parties independently arrange payment for the pigeon, collection, lawful transport and other details outside the platform. PigeonTree does not collect or hold payment for pigeons, provide escrow or settle between the parties, organise live animal transport, or guarantee payment, collection or a successful exchange. There is no in-app chat. Contact information is made available only as described in the listing and privacy policy. These terms do not exclude the provider’s statutory responsibility for its own digital service.
Browsing, publishing and bidding on auctions require a linked account; a guest session has no access to auctions. Sellers must be adults, have the right to sell the pigeon and supply verified contact details. They declare whether they are a private seller or a business. Business listings show public business information and contact details. Consumer protection rules for contracts with traders generally do not apply to a pigeon purchase between private individuals; rights under other laws remain. Statutory consumer rights when buying from a business cannot be excluded by these terms. A verified-seller label concerns identity checks, not the pigeon’s health, origin or quality, or a guaranteed exchange.
9.2. Publishing, bids and currency
An auction publishes a separate copy of selected information, photos and pedigree. Review every page before publishing and remove unnecessary private information, including text visible in images. Do not publish material without the necessary rights, other people’s data without a lawful basis, unlawful content or listings that breach animal welfare rules. False ring identities, artificial price inflation, using multiple accounts to manipulate auctions, and bypassing moderation or listing order are prohibited.
The amount, currency and binding effect are shown before bidding. One tap on a quick bid sends exactly the displayed amount without another confirmation. You confirm a custom amount, automatic maximum or Buy now according to its button or form. The automatic maximum stays private; the system bids only as much as needed, up to that limit. The server determines acceptance order and the minimum amount. A rejected bid is not automatically raised. If the outcome is unknown, check the same operation’s status before trying again.
Each auction has one immutable currency. Bids, maximum and final price use that currency. An optional display in another currency uses a public Frankfurter table; the app shows the rate date and names the source in About. This is an indicative estimate only, including when it uses a locally cached table. It does not change the auction currency, serve to settle a transaction, determine your bank’s rate or include currency-exchange fees.
An auction runs for the stated period, may have a scheduled start and may require prior moderation. A bid accepted in the final two minutes sets the end to two minutes after that bid. Buy now is available only if enabled by the seller and before the first accepted bid. Ordinary withdrawal is available before the first bid; later cases require moderation. Approved public details cannot be freely edited during an auction. The result identifies the winning bid under the auction rules; the legal effect of bids and formation of a contract between the parties follow the auction conditions and applicable law. Push notifications are a convenience and may be delayed or undelivered; check the current state in the app.
9.3. Listing order, moving up and highlighting
Ordinary results are ordered newest first by the original listing or its latest valid paid move up, subject to your search and filters. Price, bid count and viewer count do not improve its position. Cancelling and relisting a recognised pigeon identity, including under a new local identifier or another account, does not reset its first publication date or give it a free move up. Ring formatting does not create a new identity; digits, including leading zeroes, remain significant. Deliberately declaring a different ring breaches these terms. Automated matching is not proof of the actual animal’s identity.
Moving up and highlighting are two separate optional digital services. A move up puts your own active auction at the start of ordinary results once. A moved-up auction carries no separate label in the list; the order of ordinary results always follows the first publication date or the latest paid move up. New listings and later moves can appear above it. It does not reserve first place for a period of time or change the original publication date, price, bids or auction result. It does not highlight the listing or give it a highlighting slot. Placing a bid is not a purchase of this service.
Optional promotion is a separate digital service bought once through Google Play or the App Store, independently of Plus and payment for the pigeon. The store and app show its tax-inclusive price and scope before purchase. It does not automatically renew. Labelled promoted auctions receive additional exposure in designated positions; their ordinary age and bidding result do not change. Promotion does not guarantee first place, a number of views or a sale.
A purchase creates promotion credit after transaction verification. Using it activates promotion on your own active auction for the stated period, capped at that auction’s end. A refund may revoke unused credit or end an active promotion. Withdrawal and complaints are handled under applicable law and the information shown before purchase; using a credit does not automatically waive statutory rights.
A move up is a separate one-time Google Play or App Store purchase at the price and on the terms shown before purchase. A verified transaction grants one move-up credit, which cannot be used for highlighting. It can only be applied to your own active auction. If that auction ends before use, the unused credit remains available for another eligible auction of your own and does not expire. A refund revokes unused credit or removes its effect on listing order while preserving later valid moves. Checking the same transaction again does not grant another credit. Moving up does not automatically renew and is independent of Plus and payment for the pigeon; the withdrawal and complaint rights for our digital services apply.
9.4. Seller ratings
After an auction ends with a winner, the winning buyer may rate the seller once, from 1 to 5. A submitted rating cannot be changed. The public average and count appear after at least 5 ratings. We do not publish the reviewer's identity or comments. A rating is the buyer's opinion; it does not certify payment, collection of the pigeon or fulfilment of a contract. Ratings do not affect price or listing order. The verified-seller label concerns a separate identity check.
9.5. Your own loft records and reports
After an auction ends, the seller and winner can independently update their own loft, for example marking their bird as sold or adding a purchased pigeon from the public snapshot. Each person confirms only their own update. The other party does not have to approve it, and their loft is not remotely changed. This record does not certify payment, collection or transfer of ownership, and does not change the historical auction result.
A viewer counter, if shown, counts each linked account visiting an auction’s details once and excludes the seller. It is not a count of every visit or a guarantee of different people. It does not affect ranking.
Report a listing in the app or at pigeontreeapp@gmail.com. Identify the auction, issue and information needed to investigate, without unnecessary data. We may refuse publication, hide or cancel a listing, or restrict an account for unlawful content, animal welfare concerns, infringement of others’ rights, fraud or bypassing safeguards. Use the same contact to request human reconsideration of a decision or report an incorrect price or system error. Complaints about our service follow section 7; disputes about fulfilment of the pigeon sale are addressed to the other party or competent authorities and courts. Deleting an account or changing a loft record does not release obligations under a contract already concluded.
